ISLAMABAD/PESHAWAR: In a significant development, the Peshawar High Court (PHC) reinstated the “bat” symbol for the Pakistan Tehreek-e-Insaf (PTI) on Wednesday, clearing the path for the party to participate in the February 8 polls with its distinctive symbol.

The announcement of the decision came after the Peshawar High Court (PHC) conducted a hearing on PTI’s petition, which contested the Election Commission of Pakistan’s (ECP) declaration of the intra-party election as invalid and the withdrawal of their electoral symbol “bat.” The court heard arguments from all involved parties in the case.

In the court’s judgment, it characterized the decision of the Election Commission of Pakistan (ECP) as “incorrect.”

In the aftermath of the judgment, the court instructed the election oversight body to provide a certificate to the PTI and temporarily halted the decision that had deprived the party of its symbol.

“The court affirmed that PTI is a political party entitled to an election symbol.”

Today, a verdict was announced by a two-judge panel of the PHC, which included Justice Ijaz Anwar and Justice Arshad Ali.

The preceding day, the court listened to presentations from the legal representatives of both the ECP and the PTI. During today’s session, the court considered arguments from other parties involved in the case.

‘No one can stop PTI now’

Addressing the media outside the PHC following the verdict, Barrister Ali Zafar, PTI’s legal counsel, asserted, “PTI’s victory in these elections is now inevitable; no one can stop it.

Commending the decision, the PTI senator remarked that the PHC upheld its tradition of delivering judgments by the law.

“The court has directed the reinstatement of PTI’s bat symbol and immediate publication of intra-party poll results on its website,” he stated. The decision to revoke PTI’s electoral symbol has been overturned by the court. Barrister Zafar remarked, “It was a plot against PTI to strip it of the bat symbol.”

In a recent court hearing, Advocate Qazi Jawwad, representing a petitioner, expressed dissatisfaction, stating that attempts to obtain information from PTI’s head office about intra-party polls went unanswered. Despite learning about the PTI’s polls through the media, the petitioner sought nullification of the polls. Justice Anwar pointed out that the petitioner did not call for re-elections when the Election Commission annulled the intra-party polls.

Additionally, objections were raised regarding the court’s jurisdiction, arguing that the PHC’s provincial scope was limiting, given that PTI’s intra-party elections were nationwide. The court emphasized that since the polls took place in Peshawar, it held jurisdiction. Arguments also ensued about the legitimacy of the party’s bat symbol and the fairness of the electoral process.

As the legal proceedings unfolded, PTI’s counsel, Barrister Ali Zafar, accused the petitioner of attempting to undermine the party rather than seeking re-elections. The court questioned the ECP counsel about the withdrawal of the party symbol and the discrepancy in sections of the Election Act. The ECP maintained that PTI wanted the symbol after conducting illegal intra-party elections unlawful.

Despite the temporary restoration of the symbol, subsequent legal developments raised uncertainties, prompting PTI’s withdrawal from the Supreme Court and the anticipation of a decisive PHC verdict.
